Welcome to EuropaHealthLinks powered by YIY Health Services Ltd (referred to as "YIY Health Services," "we," "us," or "our"). These Terms and Conditions of Use ("Terms") govern your access to and use of the EuropaHealthLinks website and platform, including all content, features, and services offered (collectively, the "Platform").
By accessing or using our Platform, whether as a registered user or a guest, you ("User," "you," or "your") agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use our Platform.
2. Description of Services
YIY Health Services Ltd operates EuropaHealthLinks, a platform that facilitates connections between users seeking medical treatment and a network of hospitals and healthcare providers worldwide ("Hospitals"). Our Platform provides information about Hospitals, their specialties, services and may facilitate communication and appointment requests.
YIY Health Services Ltd IS NOT A HEALTHCARE PROVIDER. We do not provide medical advice, diagnosis, treatment, or healthcare services. Our Platform is solely a facilitator to help you find and connect with qualified medical professionals and Hospitals for your medical needs. The ultimate decision regarding your healthcare and treatment is solely between you and your chosen healthcare professional, Hospital(s), hospital(s), and healthcare providers.
The responsibility of offering medical advice rests on the doctors and hospitals.
3. User Accounts and Registration
Eligibility: By using our Platform, you represent and warrant that you are at least 18 years of age, have the legal capacity to enter into these Terms, and that all registration information you submit is truthful and accurate.
Account Creation: To access certain features of the Platform, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
Account Security: You are responsible for maintaining the confidentiality of your account credentials (username and password) and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.
Account Responsibility: You are solely responsible for all activity on your account, whether authorized by you or not.
4. Acceptable Use and Prohibited Conduct
You agree to use the Platform in accordance with these Terms and all applicable laws and regulations. You agree not to engage in any of the following prohibited activities:
Unlawful Use: Use the Platform for any unlawful purpose or in violation of any applicable law or regulation.
Misrepresentation: Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
Spamming and Harassment: Transmit or facilitate the transmission of unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other form of solicitation. Harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate against anyone.
Platform Disruption: Interfere with or disrupt the operation of the Platform or the servers or networks connected to the Platform.
Data Mining and Harvesting: Use any robot, spider, scraper, or other automated means to access the Platform for any purpose without our express written permission, or harvest or collect email addresses or other contact information of other users from the Platform.
Malicious Code: Transmit or distribute any viruses, worms, defects, Trojan horses, malware, or any other items of a destructive nature.
Security Breaches: Attempt to probe, scan, or test the vulnerability of the Platform or any network or breach any security or authentication measures.
Infringement: Infringe upon or violate our intellectual property rights or the intellectual property rights of others.
Misuse of Information: Use information obtained from the Platform to contact Hospitals or healthcare providers outside of the Platform's intended communication channels without our express consent.
Emergency Medical Needs: Use the Platform to seek medical assistance for emergencies or urgent medical conditions. IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, PLEASE CONTACT YOUR LOCAL EMERGENCY SERVICES IMMEDIATELY.
We reserve the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates this section, including, without limitation, reporting you to law enforcement authorities.
Furthermore, regarding your interactions with patients/clients facilitated through our Platform, you specifically acknowledge and agree to the following responsibilities:
● Accepting a patient: You are responsible for accepting a request from a patient that meets your expertise. It is the responsibility f the doctor to accept and handle patient requests based on his professional training and expertise.
● Quality of Care and Compliance: You represent and warrant to provide high-quality medical care to all Patients referred through the Platform, in accordance with applicable medical standards, laws, and regulations. Doctors shall maintain all necessary licenses, permits, and accreditations to operate as a healthcare provider in their jurisdiction.
● Communication: You are responsible for clearly and accurately communicating your expert opinion to patients following consultation.
● Managing Appointments: You are responsible for managing your appointments and adhering to the our policies regarding scheduling, cancellations, and other administrative matters.
● Data Privacy and Security: You shall comply with all applicable data privacy laws and regulations, including GDPR, NDPA, and HIPAA (if applicable), in handling of Patient data received through the Platform or in connection with this terms and condition r any other agreement.
● Professional Conduct: You agree to conduct your interaction with Patients and YIY Health Services in a professional, ethical, and courteous manner.
● Notification of Issues: You shall promptly notify YIY Health Services of any complaints, disputes, or adverse events involving Patients referred through the Platform that could reasonably be expected to have a material adverse effect on YIY Health Services' reputation or business.
5. Intellectual Property Rights
Platform Content: The Platform and its original content, features, and functionality (including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software) are owned by or licensed to YIY Health Services Ltd and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
Limited License: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal, non-commercial use in accordance with these Terms.
Restrictions: You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Platform, except as explicitly permitted in these Terms or with our prior written consent.
Trademarks: YIY Health Services Ltd's name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of YIY Health Services Ltd or its licensors. You must not use such marks without our prior written permission.
6. Disclaimer of Warranties
THE PLATFORM AND ALL CONTENT, SERVICES, AND FEATURES PROVIDED ON OR THROUGH THE PLATFORM ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

SUITABILITY FOR YOUR NEEDS: WE DO NOT WARRANT THAT THE PLATFORM OR ITS SERVICES WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL YIY HEALTH SERVICES LTD, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF YIY HEALTH SERVICES LTD HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL YIY HEALTH SERVICES LTD'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE) EXCEED THE AMOUNT PAID BY YOU, IF ANY, TO YIY HEALTH SERVICES LTD FOR ACCESSING OR USING THE PLATFORM IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED U.S. DOLLARS (USD $100.00), WHICHEVER IS GREATER. IF YOU HAVE NOT PAID ANYTHING TO YIY HEALTH SERVICES LTD, THEN YIY HEALTH SERVICES LTD SHALL HAVE NO LIABILITY TO YOU.
THIS LIMITATION OF LIABILITY INCLUDES, BUT IS NOT LIMITED TO, DAMAGES OR LIABILITY ARISING FROM:
YOUR RELIANCE ON ANY INFORMATION PROVIDED ON THE PLATFORM.
MEDICAL ADVICE OR TREATMENT RECEIVED FROM ANY HOSPITAL OR HEALTHCARE PROVIDER CONNECTED THROUGH THE PLATFORM.
THE CONDUCT OF ANY HOSPITAL OR HEALTHCARE PROVIDER, WHETHER ONLINE OR OFFLINE.
UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA.
STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE PLATFORM.
ANY OTHER MATTER RELATING TO THE PLATFORM.
8. Medical Disclaimer
YIY HEALTH SERVICES LTD DOES NOT PROVIDE MEDICAL ADVICE OR HEALTHCARE SERVICES. THE INFORMATION PROVIDED ON THE PLATFORM IS FOR INFORMATIONAL PURPOSES ONLY AND IS NOT INTENDED TO BE A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.
AS A DOCTOR, YOU ARE SOLELY RESPONSIBLE FOR ANY MEDICAL ADVICE YOU OFFER TO YOUR SELECTED PATIENTS/CLIENTS VIA OUR PLATFORM.
YIY HEALTH SERVICES LTD DOES NOT ENDORSE ANY SPECIFIC HOSPITALS, PHYSICIANS, PROCEDURES, OPINIONS, OR OTHER INFORMATION THAT MAY BE MENTIONED ON THE PLATFORM.
9. Fees and Payment
Doctor Fees: The healthcare services provided on the Platform by doctors may be charged at a set fee. Personal consultations fees are set by the doctors at the time of registering on our platform. Other services are pre-set on the Platform.
YIY Health services fees: In consideration for the services provided by YIY Health Services, service fees (either pre-set services or consultation fees) of 40% shall be deducted per every service provided Fees and Payment to Patients referred through the Platform.
Payment Terms: All payments shall be made on the Platform. Payments are processed securely through our third-party payment processor or bank account. You agree that YIY Health Services will automatically deduct from all payments received from patients/clients the service fees upfront and deposit the doctors share in their account. Refunds, if any, are at our sole discretion and will be processed according to our refund policy posted on the Platform.
10. Termination
Termination by You: You may terminate your account at any time by contacting customer support through the platform or other provided means.
Termination by Us: We may terminate or suspend your account and access to the Platform without prior notice and without liability for any reason, including but not limited to:
Your breach of these Terms.
Violation of applicable laws or regulations: Conduct that we believe is harmful to other users, our business, or our reputation.
Account inactivity for an extended period.
Effect of Termination: Upon termination, your right to use the Platform will cease immediately, and access restrictions will be applied. Sections of these Terms shall survive termination, including but not limited to Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Medical Disclaimer, Governing Law, and Dispute Resolution. will survive termination.
11. Governing Law and Dispute Resolution
Governing Law: These Terms and your use of the Platform shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria.
Dispute Resolution: Any dispute arising out of or in connection with these Terms or the Platform shall be resolved through the following methods:
Negotiation: First, attempt to resolve the dispute through good faith negotiation between the parties.
Mediation: If negotiation fails, attempt to resolve the dispute through mediation in Abuja, Nigeria under the rules of institute of chartered mediators and conciliators.
Arbitration: If mediation fails, the dispute shall be finally resolved by binding arbitration in Abuja, Nigeria in accordance with the provisions of the Nigerian arbitration and conciliation act. The language of arbitration shall be English Language. The Arbitrator shall be one (1). The arbitral award shall be final and binding and enforceable in any court of competent jurisdiction.
12. Changes to Terms
We reserve the right to modify or revise these Terms at any time, for any reason, without notice to you other than posting the updated Terms on the Platform. It is your responsibility to review these Terms periodically for changes. Your continued use of the Platform following the posting of revised Terms means that you accept and agree to the changes. Changes to these Terms will be effective as of the date they are posted on the Platform.

IN NO EVENT SHALL YIY HEALTH SERVICES LTD'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE) EXCEED THE AMOUNT PAID BY YOU, IF ANY, TO YIY HEALTH SERVICES LTD FOR ACCESSING OR USING THE PLATFORM IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED U.S. DOLLARS (USD $100.00), WHICHEVER IS GREATER. IF YOU HAVE NOT PAID ANYTHING TO YIY HEALTH SERVICES LTD, THEN YIY HEALTH SERVICES LTD SHALL HAVE NO LIABILITY TO YOU.
THIS LIMITATION OF LIABILITY INCLUDES, BUT IS NOT LIMITED TO, DAMAGES OR LIABILITY ARISING FROM:
- YOUR RELIANCE ON ANY INFORMATION PROVIDED ON THE PLATFORM.
- MEDICAL ADVICE OR TREATMENT RECEIVED FROM ANY HOSPITAL OR HEALTHCARE PROVIDER CONNECTED THROUGH THE PLATFORM.
- THE CONDUCT OF ANY HOSPITAL OR HEALTHCARE PROVIDER, WHETHER ONLINE OR OFFLINE.
- UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA.
- STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE PLATFORM.
- ANY OTHER MATTER RELATING TO THE PLATFORM.

YIY HEALTH SERVICES LTD DOES NOT ENDORSE ANY SPECIFIC HOSPITALS, PHYSICIANS, PROCEDURES, OPINIONS, OR OTHER INFORMATION THAT MAY BE MENTIONED ON THE PLATFORM.
9. Payment Terms (If Applicable - Modify if Platform is Free to Users)
Platform Fees: Access to healthcare service providers and other services offered on the Platform may require payment of fees. Fees are as described on the Platform at the time of selection of the services. Payments are processed securely through our third-party payment processor or bank account. You agree to pay all fees and applicable taxes in a timely manner. Refunds, if any, are at our sole discretion and will be processed according to our refund policy posted on the Platform
Hospital Charges: You understand and agree that YIY Health Services Ltd is not responsible for the fees charged by Hospitals for medical services. All payment arrangements for medical treatment and related services are solely between you and the Hospital. We may provide estimates of treatment costs based on information provided by Hospitals, but these are estimates only, and actual costs may vary.
10. Termination
Termination by You: You may terminate your account at any time by contacting customer support through the platform or other provided means.
Termination by Us: We may terminate or suspend your account and access to the Platform without prior notice and without liability for any reason, including but not limited to:
Your breach of these Terms.
Violation of applicable laws or regulations.
Conduct that we believe is harmful to other users, our business, or our reputation.
Account inactivity for an extended period.
Effect of Termination: Upon termination, your right to use the Platform will cease immediately, and access restrictions will be applied. Sections of these Terms shall survive termination, including but not limited to Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Medical Disclaimer, Governing Law, and Dispute Resolution. will survive termination.
11. Governing Law and Dispute Resolution
- Governing Law: These Terms and your use of the Platform shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria.
- Dispute Resolution: Any dispute arising out of or in connection with these Terms or the Platform shall be resolved through the following methods:
- Negotiation: First, attempt to resolve the dispute through good faith negotiation between the parties.
- Mediation: If negotiation fails, attempt to resolve the dispute through mediation in Abuja, Nigeria under the rules of institute of chartered mediators and conciliators.
- Arbitration: If mediation fails, the dispute shall be finally resolved by binding arbitration in Abuja, Nigeria in accordance with the provisions of the Nigerian arbitration and conciliation act. The language of arbitration shall be English Language. The Arbitrator shall be one (1). The arbitral award shall be final and binding and enforceable in any court of competent jurisdiction.
12. Changes to Terms
We reserve the right to modify or revise these Terms at any time, for any reason, without notice to you other than posting the updated Terms on the Platform. It is your responsibility to review these Terms periodically for changes. Your continued use of the Platform following the posting of revised Terms means that you accept and agree to the changes. Changes to these Terms will be effective as of the date they are posted on the Platform.
